Labor & Employment – Midlevel ADA Title III Associate (California or Washington, D.C.)

Office **Multiple Locations
Practice Area Labor & Employment
Date Posted Jul 24, 2024
Application Deadline Jul 24, 2025

Labor & Employment – Midlevel ADA Title III Associate (California or Washington, D.C.)

At Seyfarth, great people are the key to our success, and we provide the opportunities to match. If you join us, you’ll work with top practitioners in the field in a friendly and professional environment, and we will continue to invest in your professional development. If you want the freedom to grow at a firm that is invested in your future, keep reading.

THE OPPORTUNITY:

We have an exciting opportunity for an Associate with at least 3 years of  litigation experience who will become a member of the firm’s ADA Title III Team, a specialty group within the Labor & Employment Department.  Strong litigation skills are a must, and substantive experience with Title III of the Americans with Disabilities Act and/or equivalent state laws is a plus (but not absolutely necessary).  The Associate can be based out of either our California or Washington, D.C. offices.

THE DAY-TO-DAY:

You will be a part of the firm’s ADA Title III Team— a group of collegial attorneys nationwide who are some of the top practitioners and subject matter experts in the nation on Title III and other federal and state laws prohibiting discrimination against individuals with disabilities in public accommodations.  The Team handles a significant share of the more than 12,000 federal ADA Title III lawsuits filed each year, some involving the most cutting edge issues in this practice area.  Your work will include defending lawsuits brought against our Fortune 500 clients in ADA Title III litigation hotspots, with a focus on federal and state courts, counseling clients on compliance matters, and responding to DOJ and agency investigations into alleged discriminatory practices.

As part of the ADA Title III Team, you’ll have the opportunity to work on interesting, challenging, and groundbreaking cases, typically directly with one of the three partners on the Team.  This means you will learn from the best.  You will also interact regularly with the other attorneys as part of this close knit and supportive group.

YOU MUST HAVE:

  • Excellent academic credentials, analytical skills, and verbal and written skills required;
  • Admission to the California or Washington, D.C. Bar (required);
  • Strong litigation experience (e.g. writing, analysis, research, communication);
  • Experience with single plaintiff and/or class action lawsuits arising under Title III of the ADA and related state disability access laws preferred;
  • Willingness to come into the office three days a week, or more if required.

WHAT WE PROVIDE:

We provide competitive salary and benefits at all levels. For associates, we provide comprehensive training through our mentoring programs, CLE initiatives, Seyfarth University, industry credentialing, and hands-on learning by working side-by-side with our partners.

We are also proud to be an influential leader in inclusion and diversity. The firm has been recognized for our efforts by the Human Rights Campaign, the Minority Corporate Counsel Association, and Seramount (formerly Working Mother magazine). We are Mansfield 5.0 certified, a reflection of our ongoing commitment to advancing candidates from underrepresented groups.

Labor & Employment Staff Attorney or Counsel - Hourly - Remote (NATIONAL)

Office **Multiple Locations
Practice Area Labor & Employment
Date Posted Jan 31, 2024
Application Deadline Dec 31, 2024

At Seyfarth, we understand that great people are the key to our success, and we provide the opportunities to match. If you join us, you’ll work with state-of-the-art technology in a friendly and professional environment, and we will continue to invest in your professional development. If you want the freedom to grow at a firm that is invested in your future, keep reading.

THE OPPORTUNITY:

Our national Innovative Staffing Team (IST) is an elite, highly trained “swat team” of Labor and Employment lawyers who want our most flexible role: a fully-remote, hourly position that comes with the excitement of working with the best employment team in the country. We now have over 35 IST lawyers around the country, and we are attracting former partners and associates from firms as well as in-house who want the advantages and experience of working on exciting matters but not the demands of a full time, partner track position. Each of our IST lawyers are tied directly to one of our national offices, but can be physically located in many states throughout the country.  Importantly, you’ll be a member of our consistently top-ranked and nationally recognized Labor & Employment practice group.  Learn more about our Labor & Employment department.

We are expanding this team and invite you to learn more about this unique opportunity.

YOU HAVE:

5+ years of increasingly responsible employment litigation experience, preferably on the management-side.

Familiarity with and experience in federal and state court practice, as well as with the Equal Employment Opportunity Commission, Department of Labor, and other federal, state and local government administrative agencies.

Litigation experience, including drafting responsive pleadings, handling all aspects of the discovery process, and drafting motions, including motions for summary judgment. Candidates should also have the ability to handle a practice that includes handling EEOC charges, including defending investigations, preparing position statements, defending clients in fact-finding conferences and on-site visits, representing clients in mediations and conciliations, and negotiating settlements.

A collegiate, cooperative approach and enjoy working with experienced lawyers sharing ideas, resources and best practices.

A desire to work on exciting matters without the demands of a full-time, on track position.  You do the work you agree to take on, with no obligations for marketing or other contribution hours.

Strong time management skills, and a flexibility around potential work flow.  There is no billable hours expectation, and your schedule is up to you! Ideally, however, we would like candidates to commit to being available to work 1000 or more hours per hours a year depending on the specific casework.

An active bar license in the state in which you will reside.

CA Labor and Employment Counsel – Remote/Reduced Schedule (SMS)

This Counsel role is a substantially reduced-schedule and salaried position designed to be flexible on location, and is fully remote with access to any of our local offices as needed. This counsel position is and will remain fully remote.  Moreover, this is an exceptional and rare opportunity for experienced lawyers who do not seek to be in a partner-track position due to the additional nonbillable commitments of those roles, but who want to continue to do sophisticated legal work with direct client involvement, all while working with the best employment team in the country!

In this role, Counsel will routinely interface directly with clients and Firm partners, as well as provide litigation recommendations and develop defense strategy.

Lawyers in this role will handle matters in federal and state courts, and before the Equal Employment Opportunity Commission, and perhaps the Department of Labor, as well as other federal, state, and local administrative agencies. They must be able to directly run all aspects of single-plaintiff litigation, including drafting responsive pleadings, handling all aspects of the discovery process (including taking and defending depositions), drafting motions and briefs, including motions for summary judgment, and occasionally attending and handling arbitration.  Additionally, they will work on EEOC Charges, including defending investigations, preparing position statements, defending clients in fact-finding conferences and on-site visits, representing clients in mediations and conciliations, and negotiating settlements. Occasional travel, primarily within CA, may be required.

YOU HAVE:

7+ years of increasingly responsible employment law experience, preferably on the defense side.

Experience handling a single-plaintiff employment lawsuit from start to finish with minimal oversight.

Top law firm experience.

Strong academic credentials.

Stellar analytical skills; and strong verbal and written communication skills.

Admission to the California state bar.

WHAT WE PROVIDE:

We provide competitive salary and benefits at all levels, including continued hands-on learning by working side-by-side with our partners and senior counsel.
